You must be at least 18 years of age to use the Platform. By creating an account you represent that you meet this requirement and that all registration information you provide is accurate and current.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@jobmatch.hk if you suspect unauthorised access to your account.
One person or entity may not maintain more than one free Job Seeker account. Employers may maintain multiple sub-user accounts under one company account.
As a Job Seeker you agree to:
JobMatch acts as an intermediary only. We do not guarantee that any application will result in an interview or offer of employment, and we are not party to any employment contract between you and an employer.
Each job listing must describe a genuine, existing vacancy. When posting on the Platform, Employers agree to:
Hong Kong law prohibits discrimination in employment on the grounds of sex, pregnancy, marital status, disability, family status, and race. Employers must ensure all job listings and hiring practices comply with:
JobMatch reserves the right to remove any job listing that, in our reasonable opinion, contains discriminatory language or requirements in violation of the above Ordinances, without refund of any listing fees paid.
Third-party recruiters and staffing agencies must have written authority from the hiring company to post roles on their behalf and must identify that they are acting as a recruiter (not the direct employer) in the listing.
The following are prohibited on the Platform for all Users:
JobMatch reserves the right to remove any Content and/or suspend or terminate any account that violates these prohibitions, at our sole discretion and without prior notice.
Certain employer services (e.g., featured job listings, resume-search credits, premium plans) are subject to fees as set out in our pricing schedule, which may be updated from time to time. Continued use of paid features after a price change constitutes acceptance of the new fee.
All fees are quoted and charged in Hong Kong Dollars (HKD) and are inclusive of any applicable taxes unless otherwise stated.
Fees are generally non-refundable except where required by law or where JobMatch is unable to deliver the purchased service. If you believe a charge is in error, contact billing@jobmatch.hk within 30 days of the charge date.
All intellectual property rights in and to the Platform (including software, design, trademarks, and the "JobMatch" brand) are owned by or licensed to JobMatch Limited. You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely as described in these Terms.
By submitting Content to the Platform (including job listings, company descriptions, and profile information), you grant JobMatch a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and distribute that Content as necessary to operate and promote the Platform. You retain ownership of your Content.
You must not copy, distribute, modify, or create derivative works of the Platform or its Content without JobMatch's prior written consent.
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. By using the Platform you acknowledge that you have read and understood the Privacy Policy.
Employers who receive personal data about Job Seekers through the Platform (including CVs and application materials) become data users in respect of that data under the Personal Data (Privacy) Ordinance (Cap. 486). Employers must handle such data in compliance with the PDPO, use it only for recruitment purposes, and not retain it beyond the period necessary for those purposes.
The Platform is provided on an "as is" and "as available" basis. JobMatch does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We do not endorse, verify, or guarantee the accuracy of any job listing, employer information, or candidate profile.
To the fullest extent permitted by Hong Kong law, JobMatch's total liability to you arising out of or in connection with your use of the Platform shall not exceed the greater of (a) the fees you paid to JobMatch in the 12 months preceding the claim or (b) HKD 1,000.
JobMatch is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, even if advised of the possibility of such damages.
Nothing in these Terms limits liability for fraud, death, or personal injury caused by JobMatch's negligence, or any other liability that cannot be excluded under Hong Kong law.
You agree to indemnify, defend, and hold harmless JobMatch and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform in breach of these Terms; (b) your Content; or (c) your violation of any third-party right or applicable law.
You may close your account at any time from your account settings or by contacting support@jobmatch.hk.
JobMatch may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, engaged in fraudulent or abusive behaviour, or if required to do so by law. We will endeavour to give notice where practicable, but are not obliged to do so where immediate action is required to protect the Platform or other Users.
Provisions that by their nature should survive termination (including intellectual property, disclaimers, liability limitations, and governing law) will continue to apply after any termination.
We may amend these Terms at any time. Material changes will be indicated by an updated "Last updated" date and notified by email or in-platform notice at least 14 days before the changes take effect for existing Users. Your continued use of the Platform after that date constitutes acceptance of the revised Terms.
These Terms are governed by and shall be construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules.
Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties. If the dispute is not resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Hong Kong SAR.
